Divorce
Pursuant to Georgia Law, there are thirteen (13) grounds upon which a complaint for divorce may be brought by one spouse against the other. The most common ground for divorce involves a situation upon which there exists "irreconcilable differences" between the parties, thus the marriage is considered to be "irretrievably broken." One of the initial steps in a divorce action, is to determine whether the divorce will be a contested or an uncontested divorce. In making this determination, you must look at ultimately what services will be rendered by your attorney and determine whether or not the parties are able to reach a mutual agreement on all issues.
Uncontested Divorce
In an "uncontested divorce," both parties have amicably reached a private agreement on all issues including but not limited to: division of debts, division of all assets both tangible and intangible, division of personal property, division of real property, alimony, custody, visitation, child support, division of debts, medical insurance, life insurance, attorney's fees, etc.. In an uncontested divorce, the clients gathers the necessary information and requests upon his/her attorney to draft and file the appropriate legal documentation with the Clerk of Court in order for a final hearing to be obtained. At the final hearing the Court issues a Final Judgment and Decree and incorporates the parties Settlement Agreement making the same the Final Order of the Court. Contested Divorce
In a "contested divorce action," unlike an uncontested divorce action, the parties are unable or unwilling to reach a private agreement at the onset of the action on all issues. Once the Complaint for Divorce is filed with the Clerk of Court and the other party is personally served, the parties can then engage in discovery to obtain pertinent information, to prepare the case for mediation and/or trial. The parties in the meantime may have a temporary hearing pending the final outcome of the divorce action to resolve temporary issues, including but not limited to: temporary payment of debts on a temporary basis, temporary custody, temporary child support, temporary use of the residence and furnishings, temporary alimony and any other issue which is necessary to address on a temporary basis pending the final outcome of the divorce action.
